In an important decision, the Supreme Court
said that the Other Backward Classes (OBC) castes included in the Central List
have the right to reservation in appointments to the Delhi Government and
Municipal Corporation. The Supreme Court upheld the decision of the Delhi High
Court, in which the OBC (Central) certificate was held valid for appointment to
the post of special teachers in municipal schools.
This decision was given by a bench of Justices
BR Gavai and KV Vishwanathan, who dismissed the appeal of the Delhi Subordinate
Services Selection Board (DSSSB). This appeal was against the decision of the High
Court, in which the order given in January 2024 was challenged.
The matter was such that in March 2021, DSSSB
had sought applications for the post of special teacher in Delhi Municipal
Corporation, in which Tanya Ansari applied in the OBC category. The Central
Government had included Ansari's caste in the OBC list in August 2011. When
Tanya Ansari cleared the recruitment exam, she uploaded her documents and OBC
(Central) certificate. But DSSSB rejected her certificate for the Delhi
Municipal Corporation job. Tanya Ansari obtained a new OBC certificate from the
Delhi government and submitted it, but this too was not accepted by DSSSB as it
was made after the cutoff date.
Tanya Ansari challenged this decision of DSSSB in the Central Administrative Tribunal (CAT), where the decision was given in her favor in August 2023. DSSSB challenged this decision in the High Court, but the High Court rejected it in January 2024. After this, DSSSB appealed to the Supreme Court, which was also rejected by the Supreme Court.
