If the manager dies, the deputy manager has the right to look after the work of the committee

The Allahabad High Court has said that if the manager of the college management committee dies, the deputy manager has the right to look after the work of the committee. The court cancelled the order of the District School Inspector to hand over the operation of the college's bank account to the Finance and Accounts Officer to pay the salaries of teachers and staff after the death of the manager. It was said that this is against the jurisdiction and the principles of natural justice. The court directed the District School Inspector Maharajganj to take a decision on verifying the signature of the deputy manager within three weeks.

This order has been given by Justice Manish Kumar while accepting the petition of the management committee Shri Narang Sanskrit Mahavidyalaya and others. The petitioner argues that the manager of the college died on 24 January 24. After this, the inspector gave the right to operate the college's bank account to the Finance Controller and Accounts Officer on 1 February 24 without giving information and a chance to hear the management committee.

This was challenged saying that the District School Inspector does not have the jurisdiction to give such an order. This right is with the Deputy Education Director. He can authorize himself or someone else. In the absence of the manager, the Deputy Manager has the right to look after the work of the management committee, who is an elected representative. The inspector has no right to interfere in his authority. Therefore, the court accepted the petition and ordered that the order of the District School Inspector should be cancelled.
